Terms of Service
These terms are an agreement between you and the operator of Cherry (cherryshows.com) (“Cherry”, “we”, “us”). They cover your use of Cherry: the website at cherryshows.com, our Telegram bot and any other channel that links to these terms. When you confirm your age and continue, or create an account, you agree to these terms, our Privacy Policy and the policies they link to: the Acceptable Use Policy, the Refund and Cancellation Policy, the Complaints and Content Removal policy and the Data Policy. If you don’t agree, please don’t use Cherry.
1. Who can use Cherry
- You must be at least 18 years old, and old enough to view adult content where you live. Cherry isn’t for anyone under 18.
- You must answer truthfully when we ask whether you are 18 or older. Tapping “I’m 18 or older — enter”, or replying YES in a messaging app, confirms that you are, and that you agree to these terms and our Privacy Policy. We may ask you to verify your age in another way, for example with an age-check provider, and may limit your access until you do.
- You can’t use Cherry where the law doesn’t allow it.
- You must be legally able to enter into this agreement, and, when paid plans launch, to use the payment method you choose.
2. The characters
- The characters on Cherry are fictional. Their messages and photos are generated by the service, and may be wrong, inconsistent or unexpected.
- Don’t rely on anything a character says for medical, mental-health, legal, financial or other professional advice.
- Cherry isn’t a crisis or support service. If you are thinking about harming yourself or someone else, or are in danger, contact your local emergency number or a crisis line straight away.
- Memories are generated by the service and may be incomplete or wrong.
3. Photos
- Photos show fictional adult characters, not real people. Any resemblance to a real person is unintended. Every character is depicted as 18 or older.
- Photos are for your personal, non-commercial use within Cherry. Don’t republish, sell or use them to impersonate, deceive or harass anyone, or present them as real.
- You can’t upload your own photos or videos to Cherry.
- Daily limits apply to photo requests. We may change those limits.
4. Acceptable use
You must follow our Acceptable Use Policy, which forms part of these terms. In short, you must not use Cherry to:
- request, create or share any sexual content involving minors, or content that sexualises childlike characteristics or roleplay. We report suspected child sexual exploitation to the authorities.
- create sexual or intimate content of real, identifiable people, including celebrities, or content depicting non-consensual sexual activity, incest, bestiality or sexual violence.
- harass, threaten, defame or exploit anyone, or promote violence, terrorism, self-harm or hate.
- break the law, or infringe anyone’s intellectual property or privacy.
- get around our age checks, safety measures, usage limits or access controls, or try to make the service ignore them (“jailbreaking”).
- scrape, copy, reverse-engineer or overload Cherry, use bots or automation, or access another person’s conversations or account.
- share, sell or transfer your account or access.
We may review content and conversations to enforce these rules (see our Privacy Policy), and may block requests, remove content, limit features or close accounts that break them.
5. Your content
You own the messages and comments you send. You give us a worldwide, non-exclusive, royalty-free licence to store, process and use them to run, safeguard and improve Cherry, including to generate replies, memories and photos for you, and to show your comments to other members. This licence ends when your content is deleted, except where we need to keep it by law or for safety. You are responsible for what you send, and confirm you have the right to send it.
6. Accounts and linked channels
You can use Cherry in a browser without an account. Your conversation then depends on your browser’s cookies, and may be lost if you clear them. If you create an account or link a messaging channel, keep your login secure. Linked channels share one conversation and memory, and you are responsible for activity on them.
7. Price and payments
Cherry is currently free. Photo unlocks don’t cost anything, and there are no memberships, subscriptions or automatic renewals. We will tell you clearly before anything you use starts to cost money, and you will never be charged without choosing a paid plan and agreeing to its terms at checkout.
Applies when paid plans launch. Cherry is free today, and nothing in this section applies until we offer a paid plan.
7.1 Plans and prices
Before you pay, the plan page and checkout show the plan, the price and currency, any taxes, whether the charge is one-time or recurring, how often it recurs, and, for any trial or introductory offer, its length, its price and the price you will pay after it ends. You must tick a box to agree to these terms and the plan’s billing terms before you pay.
7.2 Who processes your payment
Card payments are processed by Segpay or CCBill, our authorised payment processor, which acts as the merchant of record for your purchase. Your payment is also governed by the processor’s consumer terms. We never see or store your full card number. The charge will appear on your card statement as SEGPAY.COM*CHERRY or CCBill.com*CHERRY.
7.3 Recurring billing
- A membership renews automatically at the end of each billing period, at the price shown at checkout, until you cancel. We will tell you at checkout if a plan does not renew.
- If you start a free or discounted trial, we will email you at least 7 days before it converts to a paid membership, with the amount, the date of the charge and a link to cancel.
- We will give you at least 30 days’ notice of a price change, and the new price applies from your next renewal after the notice. You can cancel before then.
7.4 Cancelling
You can cancel at any time, without giving a reason, online through the processor’s billing support site (cs.segpay.com or support.ccbill.com) or by emailing support@cherryshows.com. Cancelling stops future renewals. You keep access until the end of the period you have already paid for, and we don’t charge a cancellation fee. You will receive an email confirming your cancellation. Full details are in our Refund and Cancellation Policy.
7.5 Refunds
Refunds are covered by our Refund and Cancellation Policy. Nothing in these terms limits refund or other rights that consumer law gives you, such as the guarantees under the Australian Consumer Law or EU and UK withdrawal rights.
7.6 Billing problems and chargebacks
If a charge looks wrong, contact us at support@cherryshows.com or the processor’s billing support first, and we will work with you to fix it, including by refunding an incorrect charge. If you dispute a charge with your bank (a chargeback), we may suspend your paid access while the dispute is open, and may close an account used for fraudulent disputes. This doesn’t affect your right to dispute a charge.
8. Reporting content and complaints
- To report content, a safety concern or a suspected underage user, or to make any other complaint, follow our Complaints and Content Removal policy or email support@cherryshows.com. We review every complaint and reply within 5 business days.
- If you believe any content on Cherry shows you or another real person, or is an intimate image made or shared without consent, report it the same way. We take reported content down while we review it, and remove content that breaks these terms or the law.
- Send copyright complaints to support@cherryshows.com, with enough detail for us to find the content. We may close the accounts of repeat infringers.
9. Suspension and termination
You can stop using Cherry at any time, and ask us to delete your data as described in our Privacy Policy. We may suspend or end your access, with or without notice, if you break these terms, if we reasonably believe you are under 18, if the law requires it, or if we stop offering Cherry. If we end a paid membership for a reason other than your breach of these terms, we will refund the unused part of the period you paid for. Sections 3, 5 and 10 to 13 continue after termination.
10. Disclaimers
Cherry is provided “as is” and “as available”. To the extent the law allows, we make no promises that it will be uninterrupted, error-free or suitable for a particular purpose, or about the accuracy of anything the service generates. Some laws, including the Australian Consumer Law, give you guarantees that can’t be excluded. These terms don’t exclude them.
11. Limitation of liability
To the extent the law allows, we aren’t liable for indirect, incidental, special or consequential losses, or for loss of data, profits or goodwill. Our total liability for any claim about Cherry is limited to the greater of the amount you paid us in the 12 months before the claim, and US$100. Where the law limits how much liability can be excluded, our liability is limited to the extent it allows, for example to supplying the service again.
12. Indemnity
To the extent the law allows, you agree to cover our reasonable losses arising from your breach of these terms or your misuse of Cherry.
13. Governing law and disputes
These terms are governed by the laws that apply where the operator of Cherry is established, subject to the mandatory consumer protections of the place where you live. Nothing in these terms takes away your right to bring proceedings in the courts where you live, where your local consumer law gives you that right. Before starting proceedings, please contact us so we can try to resolve the issue.
14. Changes to these terms
We may update these terms. If a change is material, we will ask you to review and accept the new terms before you continue using Cherry. The version you accepted is recorded with your age confirmation. A change to a paid plan’s price follows section 7.3.
15. Contact
For support, complaints, legal notices or anything else, email support@cherryshows.com. See Contact and Support for billing support.
